B |     经查，驾驶员王某江饮酒之后自行启动车辆驶入高速，途中了开启车辆智驾功能。    车辆后台数据显示，行驶途中车机多次发出驾驶员接管、分心预警，但当事人已经熟睡，没有任何响应。    系统识别驾驶员无反馈，触发安全保护逻辑，直接将车辆刹停在快车道，辅助驾驶同步退出工作状态。     经抽血鉴定，王某江血液乙醇含量123.8毫克/100毫升，达到醉驾标准，已经构成危险驾驶罪。    法院一审判决，判处拘役一个月，并处罚金人民币2000元，被告人上诉后二审维持原判。     值得一提的是，庭审中当事人曾提出抗辩，认为已经开启智驾，是车辆在负责行驶，自己并非第一责任人。    法院审理明确，当前民用车辆全部为辅助驾驶，并非自动驾驶，即便开启该功能，驾驶员依旧是法定驾驶主体，负有全程监控车辆、随时接管的义务，不能把安全责任交给车载系统。    醉酒之后启动机动车在道路行驶，就满足危险驾驶罪的构成要件，辅助驾驶不能成为醉驾的免责理由。
